Terms and Conditions

These Terms and Conditions (hereinafter: the “Terms”) apply to purchases made in the webshop operated by SILVÁNIUS Bt. (hereinafter: the “Service Provider”) at www.acspince.hu (hereinafter: the “webshop”). The Terms set out the rights and obligations of the Service Provider and of the person making purchases in the webshop (hereinafter: the “Customer”).

A contract concluded in the webshop qualifies as a distance contract. The language of the contract is Hungarian. The contract does not qualify as a contract concluded in writing; the Service Provider does not file it and has not subjected itself to any code of conduct.

Matters not regulated in the Terms shall be governed by Hungarian law, in particular by Act V of 2013 on the Civil Code, Act CVIII of 2001 on Electronic Commerce Services, Act CLV of 1997 on Consumer Protection, as well as Government Decree 45/2014 (II. 26.) on the Detailed Rules of Contracts between Consumers and Businesses.

The foreign-language versions of the Terms are for information purposes only; in the event of any discrepancy, the Hungarian text shall prevail. The Service Provider may amend the Terms unilaterally; amendments apply to orders placed after their publication.

We also sell alcoholic beverages in the webshop. Alcoholic beverages may only be ordered and received by persons who have reached the age of 18. By placing an order, the Customer declares that they are aged 18 or over.

Before the product is handed over, the courier — or, in the case of collection in person, the Service Provider — may request proof of age. If the recipient does not prove that they are of legal age, the product cannot be handed over.

The essential characteristics of the products (vintage, bottle size, alcohol content, grape variety, price) are set out on the product pages. The photos are for illustration purposes; the label design may differ from vintage to vintage.

Prices are stated in forints and include VAT. Where indicated on the product page, a mandatory bottle deposit is charged in addition to the price; it is shown on a separate line in the cart and at checkout. Before the order is submitted, the checkout shows the shipping cost and the cash on delivery fee in the order summary.

In the case of an obviously incorrect price (for example, a price that is conspicuously low compared with the usual price due to a technical error), the Service Provider is not obliged to sell the product at the incorrect price. In such cases, it will offer to fulfil the order at the correct price, in the light of which the Customer may withdraw from the order.

If the ordered product sells out in the meantime, the Service Provider will notify the Customer without delay and refund any amount already paid.

• You can add the selected product to the cart using the “Add to cart” button. In the cart, you can change the quantity, remove the product and redeem a coupon code.
• The “Proceed to checkout” button takes you to the checkout, where you must enter your billing and shipping details and select the shipping and payment methods.
• Before the order is submitted, all details can be checked and corrected on the checkout page; you can change the contents of the cart by returning to the cart page.
• After accepting the Terms and the Privacy Policy, you can submit your order using the “Place order” button. Placing an order entails an obligation to pay.
• The Service Provider will confirm receipt of the order by e-mail without delay, and within 48 hours at the latest. If the confirmation does not arrive within this period, the Customer is released from being bound by their offer.
• The contract is concluded upon the Service Provider’s confirmation of the order.

We offer home delivery within Hungary. The available shipping methods are:

Shipping is free of charge for orders with a product value of 20 000 Ft or more (after deduction of the coupon discount). The Service Provider will deliver the product within 30 days of the conclusion of the contract at the latest.

Please check that the package is intact upon receipt. If the package is damaged, draw up a report with the courier or refuse to accept it. If the package cannot be delivered through the Customer’s fault, the cost of redelivery shall be borne by the Customer.

Card payment (online)

Payment is made via the secure payment system of Barion Payment Zrt. Card details are handled by Barion and are not passed on to the Service Provider.

Bank transfer

You can transfer the amount to the bank account specified in the order confirmation, within the deadline stated there. We dispatch the product once the purchase price has been credited.

Cash on delivery

You pay the purchase price to the courier when you receive the package. The cash on delivery fee is 590 Ft.

The Service Provider issues an invoice for the purchase and sends it to the Customer together with the package or electronically.

A Customer who qualifies as a consumer may withdraw from the contract without giving any reason within 14 days of receiving the product — or, in the case of several products, the product received last. The Customer may also exercise the right of withdrawal in the period between the conclusion of the contract and receipt of the product.

You can give notice of your withdrawal by means of an unequivocal statement, sent by e-mail or by post; you may also use the model form below for this purpose. Withdrawal is made in time if you send the statement before the deadline expires.

Within 14 days of the notification of withdrawal, the product must be sent back or brought back in person to 9081 Győrújbarát, Erzsébet u. 22. The direct cost of returning the product shall be borne by the Customer.

Within 14 days of receiving the notice of withdrawal, the Service Provider will refund the full amount paid by the Customer, including the shipping cost (except for any additional costs resulting from the choice of a shipping method more expensive than the cheapest standard shipping method). The refund is made using the original payment method. The Service Provider may withhold the refund until it has received the product back or the Customer has proven that they have sent it back.

The Customer is liable for any diminished value of the product resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the product.

The Customer is not entitled to the right of withdrawal in the cases listed in Section 29(1) of Government Decree 45/2014 (II. 26.), in particular in the case of a sealed product which, for health protection or hygiene reasons, cannot be returned once it has been unsealed after delivery (for example, an opened bottle).

Statutory warranty for defects

In the event of defective performance, the Customer may assert a claim against the Service Provider under the statutory warranty for defects: at their choice, they may request repair or replacement or, if this is not possible, claim a proportionate reduction of the price or withdraw from the contract. The defect must be notified without delay after its discovery; a defect notified within two months of its discovery shall be deemed to have been notified without delay. In the case of a consumer contract, the claim becomes time-barred two years after performance.

Product warranty

In the event of a defect in a movable item, the consumer may — at their choice — assert either a claim under the statutory warranty for defects or a product warranty claim. By way of a product warranty claim, only the repair or replacement of the defective product may be requested, from the manufacturer or the distributor, within two years of the product being placed on the market. In this case, the consumer must prove that the product is defective.

Wines are not subject to any mandatory guarantee prescribed by law.

If the complaint cannot be resolved, the consumer may:

• lodge a complaint with the consumer protection authority (the county government office competent for their place of residence);
• turn to the conciliation body competent for their place of residence in order to settle a dispute relating to the contract out of court. The body competent for the Service Provider’s registered office is the Győr-Moson-Sopron County Conciliation Body (Győr-Moson-Sopron Vármegyei Békéltető Testület, 9022 Győr, Szent István út 10/A; +36 96 520 217; bekelteto.testulet@gymsmkik.hu);
• bring the matter before a court.

The Service Provider is obliged to cooperate in proceedings before the conciliation body.
